Affiliate Program Terms and Conditions

Welcome to the Sleepme Affiliate Program, powered by Social Snowball. This program is designed to reward our valued affiliates for referring new customers to our products and services. By participating in this program, you agree to comply with these Terms and Conditions. Please read them carefully.

Eligibility

1. To be eligible for participation in the Sleepme Affiliate Program, applicants must be 18 years or older, have an active and valid method of payment reception, and be US-based with a US shipping address.
2. Sleepme reserves the right to approve or reject any application to the program at its sole discretion.

Program Participation

1. Affiliates will receive a unique referral link and/or code to share with potential new customers.
2. Commissions are earned on qualifying sales that are directly attributable to the affiliate's referral link or code.
3. Affiliates are responsible for ensuring their referral methods comply with all applicable laws and regulations.

Commission and Payments

1. Commission rates are subject to change at Sleepme's discretion. Affiliates will be notified of any changes.
2. Commissions are paid out on the Sleepme pay schedule one time per month after the return period has expired via a PayPal account. If the PayPal email changes, it is the responsibility of the affiliate to update the paypal information within their affiliate account to ensure proper commission payments. We will not resend payments returned due to incorrect payment email addresses.
3. Payments of commissions are contingent upon the collection of funds from the referred customer. Returned or canceled sales will result in the deduction of the corresponding commission from the affiliate's balance.
4. Commission payouts do not include tax and shipping in affiliate revenue calculations.
5. All commissions are subject to review and verification by Sleepme. This process is to ensure the integrity of the Affiliate Marketing Program and may include the delay or withholding of payment while an investigation is conducted.
6. Commissions deemed to be earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods will be voided.
7. Sleepme reserves the right to withhold or delay payment of commissions pending an investigation or breach of these terms.

Coupon and Deal Sites

1. Posting on coupon websites, such as CouponBird and Honey, is strictly prohibited. Affiliates found to be sharing or allowing their codes to be posted on such sites will be subject to immediate termination from the program and forfeiture of any pending commissions.
2. Affiliates are encouraged to report any unauthorized use of their codes to Sleepme for investigation.
3. Affiliates should not post their coupon code on large public forums that could have the same coupon code misuses as a coupon code site.

Intellectual Property and Brand Standards

1. Affiliates may not alter any brand assets provided by Sleepme without prior written consent.
2. We require that you use Sleepme approved banners, images, and logos in all Sleepme promotions, emails, and social media mentions. If you need marketing materials please contact affiliate@sleep.me.
3. All promotional materials, including but not limited to images, logos, and slogans, must be used in a manner that is respectful and consistent with Sleepme’s brand guidelines.

Moral Clause

1. Affiliate’s work is truthful, non-fraudulent, and can be documented. Ensure that the affiliate will reimburse the agency or brand from wrongful conduct if the agency or brand gets sued because of the affiliate’s actions.
2. The affiliate agrees to abide by all guidelines set in the Company’s brand standards. (For example, all blog posts, social media statuses, tweets, and/or comments should be in good taste and free of inappropriate language and/or any content promoting bigotry, racism or discrimination based on race, gender, religion, politics, nationality, disability, sexual orientation, or age).

Non-Disparagement

1. During the term of this Agreement and for one (1) year immediately following termination of this Agreement, Affiiliate agrees to refrain from any disparagement, criticism, defamation, slander of the Company and its employees, directors, clients or principal stockholders or tortious interference with the contracts and relationships of the Company.
2. The Company shall use its reasonable efforts to cause its officers, directors and principal stockholders, in each case which are acting with authority from the Company, to refrain from any disparagement, criticism, defamation, slander of Affiiliate.

Termination

1. Either party may terminate the affiliate relationship at any time with written notice.
2. Upon termination, the affiliate must cease all use of Sleepme branding, promotional materials, and referral links or codes.

Limitation of Liability

Sleepme will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this Agreement or the Affiliate Program, even if we have been advised of the possibility of such damages.

Marketing

Bidding on branded search terms across all advertising and search platforms is not allowed without prior written permission.

Amendment

Sleepme reserves the right to update and change these Terms and Conditions at any time without notice. Continued participation in the program after such changes shall constitute your consent to such changes.

Agreement

By participating in the Sleepme Affiliate Marketing Program, you agree to abide by these Terms and Conditions. You understand that violation of any terms may result in the termination of your participation in the program and forfeiture of any accrued commissions.
